Terms of Service

Effective date: 1 May 2025

1. Acceptance of terms

By accessing or using the Erban X platform (“Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these terms on behalf of yourself or your organisation.

3. Your account

  • You are responsible for maintaining the security of your account credentials.
  • You must promptly notify us of any unauthorised access at legal@erbanx.com.
  • You may not share your account or use the Service to impersonate others.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorised access to any part of the platform.
  • Reverse-engineer, decompile, or scrape the Service.
  • Upload malicious code or interfere with platform operations.

5. Your data

You retain ownership of all data you enter into the platform. By using the Service, you grant Erban X a limited licence to store and process your data solely for the purpose of providing the Service.

6. Marketplace — professional and vendor obligations

If you register as a Professional or Vendor on the Erban X marketplace, you additionally agree to:

  • Provide accurate information about your skills, qualifications, and availability.
  • Complete identity verification (NIN) before accepting bookings or listing products.
  • Deliver services or goods to the standard described in your listing and agreed with the client.
  • Communicate professionally and respond to client enquiries within a reasonable time.
  • Not solicit clients off-platform to avoid Erban X fees.
  • Comply with all applicable Nigerian laws, including consumer protection and tax obligations.

Erban X acts as a marketplace intermediary only. We are not a party to contracts between professionals/vendors and clients, and we are not responsible for the quality, safety, or legality of services or goods provided.

7. Dispute resolution between users

If a dispute arises between a client and a professional or vendor:

  1. The parties should first attempt to resolve the issue directly through the in-app messaging.
  2. If unresolved within 48 hours, either party may submit a complaint via the Erban X support channel at erbanx.com/support.
  3. Erban X will review the complaint and relevant evidence within 5 business days and issue a non-binding recommendation.
  4. If the dispute remains unresolved, parties may seek resolution through the appropriate Nigerian consumer protection body or courts.

Erban X reserves the right to suspend accounts involved in repeated or bad-faith disputes pending investigation.

8. Payments, billing, and refunds

Subscription fees are billed in advance on a monthly or annual basis in Nigerian Naira (₦). Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.

  • Subscription fees are non-refundable once billed, except where required by applicable Nigerian law.
  • Marketplace payments (client-to-professional or client-to-vendor transactions) may be eligible for a refund if the professional or vendor fails to deliver the agreed service or product. Refund requests must be submitted within 7 days of the agreed delivery date via our support channel.
  • Price changes: We will notify you at least 30 days before any change to subscription pricing. Continued use after the effective date constitutes acceptance of the new price.

All payments are processed by Paystack. Erban X does not store your card details.

10. Limitation of liability

To the maximum extent permitted by law, Erban X shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability in any matter is limited to the amount you paid us in the preceding 12 months.

11. Termination

We may suspend or terminate your account if you violate these terms. You may terminate your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately.

12. Changes to these terms

We reserve the right to modify these terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance of the new terms.

13. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Lagos State, Nigeria.
